TERMS AND CONDITIONS

§1. General

The following terms and conditions (also referred to as "the agreement") apply to all orders placed by a customer (also referred to as "you") at lindaronnlund.com (also referred to as "the website", "me" or "I").

By using the website and/or placing an order, you agree to be bound by these terms and conditions. Please make sure you have read and understood them before placing your order.

To place an order you must be 18 years or older.

§2. Prices and fees

All prices are displayed in Swedish krona ("SEK") and include the statutory Value Added Tax when applicable.

Currency conversion fees may apply for international buyers, see §3. Delivery charges are displayed separately during the check-out process, see §5.

§3. Payments

All transaction are to be made in SEK. For international purchases, including commissions, the amount to be payed is subject to the current exchange rate at the time of payment.

Payment options

You can pay for your artwork as set out below:

Debit or credit card via Stripe

If your local currency is not SEK, currency conversion fees may apply. Refer to the payment platform provider for pricing details.

Bank transfer (for holders of Swedish bank accounts only)

Instructions for bank transfers are included in the order confirmation sent to you after purchase.
If I have not received your payment within one working day after purchase I reserve the right to cancel your order.

§4. Conclusion of contract

Conclusion of this contract will be commensed after full payment has been received.

If I am unable to fulfill your order, I will let you know at the earliest opportunity. If I have already received payment for such order, I will attempt to refund the applicable amount using the same method that you used to make the payment. If, for some reason, alternative arrangements are necessary I will contact you to settle the refund.

§5. Delivery

Orders are shipped to the address stated by you at the time of purchase, unless otherwise agreed.

Delivery charges

Delivery charges depend on the size and weight of the parcel, as well as on your shipping location. Information about delivery charges is disclosed at the time of purchase, before the order is completed.

Customs and import taxes

International buyers are responsible for any import taxes and fees that might apply.

Tracking

When possible I will provide you with a tracking number, but please know that this service is not available to buyers in all countries.

You will be asked to present identification when collecting your package.

Delivery time

Artwork available for purchase in the shop are normally sent within 5 working days.

Delivery times for commissions depend on my availability as well as the size and nature of the work. An approximate completetion date will be established before payment.

Delays

In the event of a delay causing you significant inconvenience, you may cancel your order*,**. This is also true if I cannot keep a delivery time that is critical to you, as long as you have informed me about this before entering the agreement. If the purchase concerns a customized item, and I cannot take the artwork back without economic loss, you may only cancel the order if the purpose of the purchase has essentially failed, and I realised this or should have realised this.

*When commissioning an artwork, you agree that the disclosed delivery time is approximate.
**I am not responsible for delays due to customs. Delays due to customs are not accepted as a valid reason for cancellation.

Transport risks

In the event of your artwork being lost in transit you will receive a full refund. My liability for the shipment ends when your order has been delivered to you in accordance with our agreement.

Unclaimed parcels

Unclaimed parcels are handled at your expense. Unclaimed parcels are not accepted as returns or withdrawals/cancellations.

§6. Withdrawal of order

Right of withdrawal

If you enter this agreement as an individual you are entitled to a 14 days right of withdrawal in accordance with the Act on Distance and Off-Premises Contracts (SFS 2005:59). Please not that this does not apply to custom-made items.

If you wish to withdraw your purchase you must contact me in writing within 14 days of delivery.
The item must be returned in unchanged condition within 14 days of the date on which you notified me of your withdrawal.

Return shipping costs

If you chose to withdraw your purchase you must pay for the return freight.

Depreciation deduction

If the artwork is returned in damaged condition (this includes, but is not limited to, transport damages due to inadequate packing, stains, loose or matted fibers, and re-positioning of limbs), you will be obliged to pay for any loss in value.

§7. Complaints

If you receive a defective/damaged artwork, or if the artwork is not as agreed, please contact me in writing promptly using the contact form on the website, or by sending an email to info@lindaronnlund.com.

Return shipping costs

If your complaint is valid, and you wish to return you artwork, your shipping expenses will be reimbursed given that your chosen option for shipping includes appropriate insurance and is reasonable with regards to the artwork's size and weight. You must provide me with a copy of the shipping receipt as a means of proof of the artwork having been shipped.

§8. Returns

Artworks must be safely packaged during transport. Preferably using the same packaging in which it arrived, provided that this is in undamaged condition. Please use tracked shipping and make sure the parcel is appropriately insured. You must provide a shipping receipt as a means of proof of the artwork having been shipped.

Please contact me for instructions on how to return your artwork before shipping.

§9. Refunds

I will issue a refund promptly if you withdraw a purchase or return a faulty item. The full amount, including shipping costs as described in §6 and §7, will be reimbursed within 14 days of receiving the returned artwork.

Please note that I am not responsible for any import taxes or fees you might have payed.

§10. Disclaimers

Customized artwork

Exact likeness is not guaranteed for commissioned portraits. I recommend that you refer to the artworks presented on the website to form an opinion on my artistic style before placing an order. I reserve the right to decline orders which, for whatever reason, do not coincide with my artistic ambitions.

Discrepancy between publications

In case of discrepancy between information on the website and other publications, the website has prescedence unless the information is obviously faulty or misguiding.

Liability

My entire liability to you under this agreement shall not exceed the amount in SEK charged by me for the items you have purchased.

If a customer has acted in bad faith because of faults of which the customer was aware or should have been aware, such as incorrect pricing or quantity on the website, the customer is not entitled to economic compensation.

Withdrawal

I reserve the right to cancel any order, at any time, for personal reasons. If an order is cancelled due to events that are within my control, a full refund will be issued promptly.

If I am made aware that a portrait of an individual (other than the buyer, and not a public figure) has been commissioned under false pretense (i.e. the individual has not approved to having his or her portrait made), I will cancel the order and deduct up to the full amount to cover my expenses.

Force majeure

In the event of any non-performance caused by circumstances beyond my control, such as difficulties and disturbances including, but not limited to, government decisions, labour conflicts; riot; civil disturbance, war; extreme weather conditions; fire; accidents; fuel or power shortages; and transportation shortages, obstacles or interuptions, I have the right to withdraw from this agreement without liability for any incurred losses.

§11. Ownership of rights

All intellectual property rights, such as trademarks and copyrights, at lindaronnlund.com remain with the artist. Any use of the website or its contents, including copying or storing such content in whole or part, other than for your own personal, non-commercial use, is prohibited without the permission of the owner.

Please note that images of previously sold artwork may be used by me (or a licensee) for marketing or other commercial purposes, including merchandise, on this website and elsewhere.

§12. Disputes

If you have an issue with your order and you were not able to settle the complaint with me, you can submit a complaint to the EU's Online Dispute Resolution platform ("ODR"): https://ec.europa.eu/odr
